class=\"wp-block-paragraph\">As one CEO put it in the <a href=\"https:\/\/www.cannabisbusinesstimes.com\/article\/beau-wrigley-interview-parallel-cannabis\/\" target=\"_blank\" rel=\"noopener\">Cannabis Business Times<\/a>: \u201cI think it\u2019s going to be a while before [the cannabis industry] really looks like a CPG business\u2026 you\u2019ve got regulations on packaging and you can\u2019t ship products across state borders. And then every state has a different regulatory environment, so you don\u2019t have any consistency for mass marketing.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So what is the best way for brands to <strong>meet the challenges of an ever-changing and complex regulatory environment <em>without<\/em> sacrificing ever-crucial brand real estate<\/strong>?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this article, we\u2019ll provide information on:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Labeling methods you can use to fit regulatory requirements<\/li>\n\n\n\n<li>Key industry insights on the importance of cannabis product branding<\/li>\n\n\n\n<li>And, crucially, how to strike a balance between the two<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Plus, we\u2019ll share criteria for evaluating a supplier specifically for cannabis and CBD labeling needs. With this guidance, you can steer your brand through the labeling and branding challenges and achieve a product that repeatedly earns a spot in the ever-expanding cannabis consumers\u2019 carts.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Achieving cannabis label compliance<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Including state labeling requirements is of course essential for selling your products in dispensaries. But there\u2019s more at stake than just legality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Take these instances: A study from the Journal of the American Medical Association (<a href=\"#references-section\">1<\/a>) found that many CBD products sold online missed the mark when it came to accurate labeling: Two-thirds of tested products contained either more or less CBD than claimed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And for one Ohio cannabis brand, a labeling error led state regulators to stop sales of their medical marijuana vaping oils at 13 of 15 retail shops (<a href=\"#references-section\">2<\/a>) \u2014 risking not just consumer trust, but profits as well.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So in order to be in <strong>good legal standing, gain the trust of shoppers<\/strong> and <strong>protect the bottom<\/strong> <strong>line<\/strong>, brand owners must follow the cannabis label requirements laid out by the state.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is easier said than done as there is currently no federal guidance and each state controls its cannabis legislation (and thus the labeling guidelines).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s a similar uphill battle for CBD specifically: The 2018 Farm Bill legalized industrial hemp and thus CBD-derived products, but the federal labeling guidelines are still a work in progress. All product labels need to follow the relevant FDA guidelines based on the product type (i.e. food, cosmetic or dietary supplement) plus include the state-specific CBD packaging requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And for multi-state operators (MSOs), this proves even more challenging as they must manage each state as a siloed entity and follow state-by-state requirements that may differ slightly or drastically.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As the industry matures and becomes federally legal across the country \u2014 BDSA predicts federal legalization in 2022 (<a href=\"#references-section\">3<\/a>) \u2014 packaging regulations will hopefully be easier to implement. But in the meantime, <strong>brands owners must keep up with their states<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Speaking generally, CBD and cannabis labels could be required to include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Product name and identity<\/li>\n\n\n\n<li>Net weight or volume<\/li>\n\n\n\n<li>Serving size<\/li>\n\n\n\n<li>Universal symbol, hemp symbol or medical grade symbol<\/li>\n\n\n\n<li>THC % and CBD %<\/li>\n\n\n\n<li>Activation time<\/li>\n\n\n\n<li>Lab name and test # confirmation<\/li>\n\n\n\n<li>Date tested<\/li>\n\n\n\n<li>Strain name<\/li>\n\n\n\n<li>Business or trade name and license\/registration number<\/li>\n\n\n\n<li>Manufacturer name and address<\/li>\n\n\n\n<li>FDA disclaimer (for CBD)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Once again, <u>the information provided here is a generalization of cannabis label requirements and is not to be interpreted as legal advice<\/u>.
